In this Privacy Policy (the "Policy"), "Acre AI", "we", "us", or "our" refers to ACRE AI. Your use of the Acre AI platform, including the web application at https://deals.acreai.com/, and all related features and services (collectively, the "Services") is subject to the terms of this Policy.

PLEASE READ THIS POLICY CAREFULLY BEFORE USING THE SERVICES. BY ACCESSING OR USING THE SERVICES, YOU AGREE TO THE TERMS OF THIS POLICY IN THEIR ENTIRETY. IF YOU DO NOT AGREE, PLEASE STOP USING THE SERVICES.

1. ACRE AI VALUES YOUR PRIVACY

This Policy outlines how your personal information ("Visitor Information") may be collected, used, and shared in connection with your access to and use of the Services, including through any third-party applications or platforms connected to Acre AI (such as Zillow, Google Maps, and county assessor portals).

This Policy also describes your choices and rights regarding the use, access, and correction or deletion of your Visitor Information. By visiting or using the Services, you consent to the use of your Visitor Information in accordance with this Policy.

Acre AI does not collect or process any data regarding the following: race or ethnic origin; political opinions; religious or philosophical beliefs; trade union memberships; genetic or biometric data; health or mortality; or sexual orientation.

2. INFORMATION WE COLLECT AND HOW WE COLLECT IT

2.1 Information You Provide Directly

When you register for an account, submit a funding application, or otherwise interact with the Services, we may collect:

  • Full name
  • Email address
  • Phone number
  • Mailing or business address
  • Property addresses and parcel identification numbers (APNs) you search or submit through the platform
  • Purchase price estimates and deal details submitted through the Get Funding feature
  • Deal agreements and supporting documents you upload
  • Payment and billing information, processed through our third-party payment processor, Stripe, Inc.
  • Your response to the "Why Is This Deal Good?" field in funding applications
  • Communications you send to us, including contact form submissions, feedback, and support requests.

All personal information you provide must be true, complete, and accurate. You are responsible for notifying us of any changes. You always have the option not to provide requested information, but choosing not to do so may prevent us from providing certain features or services to you.

2.2 Information Collected Automatically

When you use the Services, we automatically collect certain technical and usage information, including:

  • IP address and approximate geographic location
  • Browser type, version, and language settings
  • Operating system and device type
  • Pages viewed, features accessed, and actions taken within the Services
  • Search queries, APN lookups, and filter inputs entered into the platform
  • Timestamps of access and duration of sessions
  • Referring URLs and exit pages
  • Error logs and crash reports

This information does not reveal your specific identity but is primarily needed to maintain the security and operation of the Services, and for our internal analytics and reporting purposes.

2.3 Location Information

The Acre AI New Listings Feed uses your approximate location to surface relevant land listings in your area. Location is detected based on your IP address or, where you grant permission, your browser's location services. You may adjust location permissions in your browser settings at any time. Restricting location access may limit certain features of the platform.

2.4 Apply for Funding Feature Data

When you submit a funding application through the Get Funding feature, we collect the deal-specific information you provide, including property address, estimated purchase price, your deal rationale, and any uploaded deal agreement documents. This information is used to evaluate your application and communicate a funding decision. See Section 4.2 for information on how this data may be shared with funding partners.

2.5 Log Files

Our servers log information about your IP address, browser type, and the URL you are requesting. This information is automatically provided by your browser and logged to a secure location. It is used in our internal analysis of traffic patterns and for security purposes.

2.6 Web Beacons

Our web pages and emails may contain electronic images known as web beacons (also called pixel tags or clear GIFs). These are used to recognize users, assess traffic patterns, identify preferred content, and measure engagement. Web beacons in emails allow us to count how many messages have been opened. Some web beacons may be placed by third-party service providers to help determine the effectiveness of campaigns. These may place a persistent cookie on your device, allowing the service provider to recognize your device on return visits.

2.7 Information From Third-Party Sources

We may receive supplemental information from third-party sources, including:

  • Public property records and county assessor databases
  • Third-party real estate data providers used to power platform features
  • Payment processors, for billing and fraud prevention purposes

3. COOKIES AND SIMILAR TECHNOLOGIES

Like many businesses, we collect information through cookies and similar technologies. When you visit or log in to the Services, cookies and similar technologies may be used by us or our online data partners to associate these activities with other information they or others have about you.

A cookie is a small data file written to your device by a web browser. It can contain and automatically collect information, such as a session identifier or IP address, that the platform uses to track pages visited and frequency of visits. Cookie data may be linked to both personally identifiable and non-personally identifying information.

We and our partners may use cookies to personalize your experience, enable platform features, safeguard against spam and malware, analyze traffic and user behavior, administer the Services, remember your preferences, and perform location-related functionalities.

Cookies fall into the following categories:

Essential Cookies: Required for the platform to function. These enable core features including account login, session management, and security. Without them, Acre AI may not be able to provide core platform functions.

Preference Cookies: Collect and process information about your settings and preferences to optimize your experience. These include cookies that remember your last search criteria, map view preferences, and filter configurations.

Analytics Cookies: Help us understand how users interact with the Services, which features are used most, and where errors occur. We use tools including Google Analytics, which transmits anonymized traffic data to its servers. Google Analytics does not collect personally identifiable information. Advertising Cookies: Used to personalize content and advertising you may see in connection with the Services. These cookies help Acre AI and certain third-party providers deliver content more relevant to your interests.

You may turn off cookies through your browser settings or have your browser warn you before accepting cookies. Disabling essential cookies may prevent you from accessing certain features of the platform.

Most web browsers include a Do-Not-Track (DNT) feature. Because no uniform standard for recognizing DNT signals has been finalized, we do not currently respond to DNT signals. If a standard is adopted that we are required to follow, we will update this Policy accordingly.

4. HOW WE USE YOUR INFORMATION

We collect, process, and disclose your Visitor Information only for specific and limited purposes. Our primary goal is to provide you with the Services, enhance your experience, support the platform, and improve its features.

Specific uses include:

Providing and operating the Services: Processing your account registration, delivering platform features including the Interactive Map, New Listings Feed, Market Snapshot, Advanced Search, and Get Funding.

Processing funding applications: Reviewing deal details, property information, and documents you submit through the Get Funding feature, assessing funding eligibility, and communicating decisions.

Email and marketing communications: Sending transactional emails such as account confirmations and funding updates, and marketing communications where you have consented or where permitted by applicable law. You may unsubscribe from marketing emails at any time using the link in any email we send. Email communications are managed through Klaviyo. Improving the Services: Analyzing usage patterns, diagnosing technical issues, testing new features, and making improvements to the platform.

Security and fraud prevention: Detecting and preventing unauthorized, fraudulent, or illegal activity, and protecting the rights and safety of Acre AI, our users, and third parties.

Legal compliance: Meeting applicable legal requirements, responding to lawful requests from authorities, and enforcing our Terms and Conditions.

5. OUR THIRD-PARTY VENDORS

Stripe, Inc.: We collect limited payment data through the Services for processing by Stripe. All payment transactions are processed in adherence to the Payment Card Industry Data Security Standard (PCI-DSS). We currently accept VISA, MasterCard, Discover, and American Express. Klaviyo: An email marketing platform used to manage our subscriber list, send marketing and transactional emails, and track campaign results. You can review Klaviyo's privacy policy at https://www.klaviyo.com/legal/privacy-notice.

Google Analytics: An analytics service used to understand traffic and usage patterns across the Services. Analytics data is anonymized and does not include personally identifiable information. You can review Google's privacy policy at https://policies.google.com/privacy.

6. HOW WE SHARE YOUR INFORMATION

6.1 Service Providers

We share information with third-party vendors who perform functions on our behalf, as described in Section 5. These providers are contractually required to use your information only as directed by us and in a manner consistent with this Policy.

6.2 Funding Partners

If you submit a funding application through the Get Funding feature, your deal information, property details, and supporting documents may be shared with Acre AI's capital partners or affiliated funding entities for the purpose of evaluating and processing your application. Funding partners are required to handle your information confidentially in accordance with applicable law.

6.3 Affiliated Entities

Acre AI may share information with affiliated companies under common ownership, including Discount Lots, LLC (discountlots.com), for operational and service delivery purposes consistent with this Policy.

6.4 Vital Interests and Legal Requirements

We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person, illegal activities, or as evidence in litigation in which we are involved. We may also disclose information in response to a valid legal process, including a subpoena, court order, or government investigation.

6.5 Business Transfers

We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. We will provide notice before your information is transferred and becomes subject to a different privacy policy.

6.6 With Your Consent

We may share your information with third parties in other circumstances when you have given us explicit consent to do so.

7. PAYMENT CARD INDUSTRY DATA SECURITY STANDARD (PCI-DSS)

We follow the Payment Card Industry Data Security Standard (PCI-DSS) when handling credit card data. All payment transactions are processed by our third-party payment processor, Stripe, Inc., in adherence to PCI-DSS and other applicable standards.

8. THIRD-PARTY WEBSITES AND SERVICES

The Services may contain links to or integrations with third-party websites, including real estate listing sites, county assessor portals, and mapping services. We do not have control over these third-party websites and do not endorse them. We are not responsible for the privacy policies or practices of any third-party website. We encourage you to review the privacy policy of each website you visit before submitting any personal information.

9. DATA RETENTION

We retain your personal information for as long as your account is active or as needed to provide the Services. We also retain information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

If you close your account, we will delete or anonymize your personal information except where retention is required by applicable law or where information has been anonymized for analytical use.

Deal documents and funding application data may be retained for longer periods as required by applicable financial and legal record-keeping obligations.

10. SECURITY

We implement reasonable technical and organizational measures to protect your information against unauthorized access, disclosure, alteration, and destruction. These include encryption of data in transit using TLS, access controls, and regular security reviews.

No method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee the absolute security of your information. If you believe your account has been compromised, contact us immediately at support@acreai.com.

11. YOUR PRIVACY RIGHTS AND CHOICES

You may review and update your account information at any time through your account settings or by contacting us at support@acreai.com.

You may opt out of receiving marketing emails from Acre AI at any time by clicking the unsubscribe link in any marketing email or by contacting us at support@acreai.com. You will continue to receive transactional emails related to your account and any active funding applications.

11.3 California Residents: CCPA and CPRA

We collect and use your personal data for the purposes described in this Policy. This Policy, as amended, and the disclosures contained herein serve as a Notice at Collection under the California Privacy Rights Act (CPRA) and other applicable data privacy regulations.

If you are a California resident, you have the following rights:

  • Right to Know: You may request information about the categories and specific pieces of personal information we have collected about you, the sources from which we collected it, the purposes for which we use it, and the categories of third parties with whom we share it.
  • Right to Delete: You may request deletion of personal information we have collected from you, subject to certain exceptions permitted by law.
  • Right to Correct: You may request correction of inaccurate personal information we hold about you.
  • Right to Opt Out of Sale or Sharing: Acre AI does not sell personal information.
  • Right to Limit Use of Sensitive Personal Information: Where we collect sensitive personal information, you may request that we limit its use to what is necessary to provide the Services.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CPRA rights.

To submit a request, contact us at support@acreai.com. We will respond within 45 days of receiving a verifiable consumer request. You may designate an authorized agent to make a request on your behalf.

12. CHILDREN'S PRIVACY

The Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If we become aware that we have collected personal information from a minor, we will take steps to delete that information promptly. If you believe a minor has provided us with personal information, contact us at support@acreai.com.

13. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. When we make changes, we will update the Last Updated date at the top of this document. If the changes are material, we will notify you by email or through a notice within the Services prior to the change taking effect. Your continued use of the Services after any update constitutes your acceptance of the revised Policy.
